OK, so we have to go to an address in Poppleton, an address we don't know and we are following satnav. I see a sign for bus lane ahead and register it thinking I know to avoid it - no matter what the time restrictions are I try to stay out of bus lanes because the cameras are so wick and you can easily get caught for a mistake.
the sat nav takes us on and on and we don't see a bus lane but we do come to a 'no entry. buses only' sign. I drive up to it, turning to the right so that I can reverse into a factory entrance on the left and go back the way we came (turns out we had passed the address and sat nav had got it wrong).
A few days later Maggie rings me while I'm out and tells me she has had a fine for driving in a bus lane and she has paid it as it doubles after a period of time. She can't remember when but feels very intimidated by the letterm assumes she must have driven in a bus lane by mistake, so paid to avoid the extra penalty.
When I get home I read it and realise we have been penalised for driving up to the no entry and turning round. The photographic 'evidence' does NOT show us driving through (well, it can't because we didn't). In fact, in the pic you can clearly see the reversing lights so it is obvious we are not going through. I click the link to the video evidence - the video clip is only 6 seconds long and stops as I start to reverse. We can't have driven through a 'beam' to trigger the camera as it starts as we approach the signs.
I say to Maggie she shouldn't have paid this as we would have contested it, however there is a phone number to contact so I ring it. They can't/won't do anything - I have to submit an appeal in writing as the fine has already been paid. I write to the Council explaining everything, requesting that the PCN be cancelled and the fine re-imbursed.
No response. Not even an acknowledgement.
I wait several weeks and write again. I recap the whole situation, again and give them a 2-week deadline otherwise a late payment charge will be added.
Again – we failed to receive the courtesy of a reply or even an acknowledgement. So I wrote to the Leader of the Council.
This time I got an email acknowledgement from his secretary, sorry, Executive Support Assistant, stating that it had been passed to Graham Titchener, Head of Parking Service to 'review and respond.'
He did respond - not to us, but to the Leader of the Council, but only to say that if you enter the restricted zone in any way you are guilty and, 'if it is any consolation' the footage had been reviewed by a person. It wasn't just automated.
NO - it wasn't a bloody consolation. This makes it even worse - some numpty bureaucrat has watched the footage of us drive up to the sign, stop, reverse and drive away and STILL taken the decision to fine us.
We never did get our money back. Time went on and we didn't get it pursued. They rely on this - on intimidation and inertia.
We didn't drive into that restricted zone. We drove up to it so we could reverse into the factory entrance to return the way we had come. Some bureaucrat still took the decision to fine us and when we complained we didn't even get the courtesy of an acknowledgement.
